1. Intellectual Property & Artwork Submissions
Unless otherwise stated, we and/or our licensors own the intellectual property rights for all material on this website. All intellectual property rights are reserved.
- Customer Artwork: By submitting artwork, logos, designs, or specifications for custom packaging (including Mylar bags, boxes, or labels), you warrant that you own the intellectual property rights or have explicit permission to use and reproduce the designs.
- Indemnification: You agree to indemnify and hold our company harmless from any claims, liabilities, damages, or costs arising out of copyright or trademark infringement claims related to the artwork you provide.
2. Proofing, Approvals, & Production Tolerances
- Final Approval: Production will not begin until we receive written or digital approval of the final digital or physical proof. Once a proof is approved by the customer, no changes can be made, and the customer assumes full responsibility for any layout, text, or sizing errors.
- Color Matching: Due to the technical variations in printing presses, substrates, ink blends, and monitor calibrations, a 100% exact color match cannot be guaranteed. Orders will be produced within industry-standard commercial color tolerances.
- Size and Quantity Tolerances: Custom manufacturing involves complex machinery setup. We reserve the right to a manufacturing over-run or under-run tolerance of up to 10% of the ordered quantity. Invoices will be adjusted or credited accordingly. Minor variances in dimensions (within a few millimeters) are standard in custom die-cutting operations.
3. Pricing, Payments, & Cancellations
- Quotes: All custom quotes provided via our website or email are valid for 30 days unless otherwise specified.
- Payment Terms: Due to the entirely customized nature of our products, full production payment (or an agreed-upon technical deposit) is required before custom tooling, plates, or manufacturing begins.
- Cancellations: Once production begins or materials unique to your order are purchased, orders cannot be cancelled, refunded, or modified.
4. Shipping, Delivery, & Turnaround Times
- Turnaround Estimates: Production and shipping times are estimates, not absolute guarantees. Unexpected technical delays, customs clearances, or supply chain disruptions do not entitle the customer to financial compensation or order cancellation.
- Shipping Liability (FOB Shipping Point): Unless otherwise agreed in writing, all goods are shipped FOB (Free on Board) from our manufacturing facilities or warehouses. Risk of loss and title pass to the buyer upon delivery of the goods to the carrier. We are not liable for shipping delays, damages, or losses caused by third-party freight carriers.
5. Defective Goods & Claims
- Inspection Period: The buyer must inspect all shipments immediately upon receipt. Any claims regarding manufacturing defects, shortfalls, or incorrect specifications must be submitted in writing within 7 business days of delivery.
- Remedy: If a product is verified by our quality control team to possess manufacturing defects outside of normal tolerances, our liability is strictly limited to either replacing the defective goods or issuing a store credit. We are not liable for any consequential, indirect, or incidental damages.
6. Limitation of Liability
To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to our website and the use of this website. We will not be liable for any loss or damage of any nature arising from your use of, or inability to use, this website or our customized goods.
7. Governing Law
These Terms and Conditions will be governed by and construed in accordance with local and national corporate laws, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the regional courts where our primary manufacturing office is registered.
