By accessing or using capitalpackaging.us, placing an order, or requesting a quote, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our website or services. Capital Packaging LLC reserves the right to update these terms at any time, and continued use of the website constitutes acceptance of any revised terms.
2. Our Services
Capital Packaging LLC specializes in custom-manufactured packaging solutions in the USA, including custom boxes and mylar pouches. All products are made-to-order based on customer-approved specifications. We serve businesses of all sizes across the United States.
3. Ordering Process
All orders are processed through our Add to Cart / Get a Quote system. An order is considered confirmed only after:
- The customer has reviewed and approved the final design and specifications
- Payment has been received and verified
Capital Packaging LLC reserves the right to refuse or cancel any order at its discretion, including in cases of pricing errors, suspected fraud, or inability to fulfill the request.
4. Pricing & Payment
All prices are quoted in US Dollars (USD) and are subject to change without notice. Prices are locked in at the time of quote approval. Full or partial payment may be required before production begins, as communicated at checkout or during the quoting process.
We accept major payment methods including credit/debit cards and other methods listed at checkout. All transactions are processed securely. Capital Packaging LLC is not responsible for payment failures caused by your bank or payment provider.
5. Custom Artwork & Intellectual Property
By submitting artwork, logos, graphics, or design files, you confirm that you own or have the legal right to use all submitted materials. You grant Capital Packaging LLC a limited license to use your submitted artwork solely for the purpose of fulfilling your order.
Capital Packaging LLC will not reproduce, resell, or share your artwork without your consent. However, we may use generic product images for portfolio or marketing purposes unless you explicitly request otherwise in writing.
You are solely responsible for ensuring your artwork does not infringe upon any third-party copyright, trademark, or intellectual property rights. Capital Packaging LLC accepts no liability for such infringements.
6. Production & Turnaround Time
Standard production takes 4 to 6 business days following order and artwork approval. Turnaround times are estimates and are not guaranteed. Capital Packaging LLC is not liable for delays caused by factors outside our control, including supplier delays, carrier issues, or force majeure events.
Rush production is available upon request and may be subject to additional fees.
7. Shipping & Delivery
Standard delivery takes 5 to 10 business days after production. Shipping costs and methods will be communicated prior to order confirmation. Title and risk of loss transfer to the customer upon handover to the carrier.
Capital Packaging LLC is not responsible for delays, losses, or damages caused by the shipping carrier once the order has been dispatched. It is the customer’s responsibility to provide an accurate and complete shipping address. We are not liable for orders delivered to an incorrect address provided by the customer.
8. Order Cancellations
Orders cannot be cancelled once production has begun. Cancellation requests made before production starts will be considered on a case-by-case basis, and a cancellation/setup fee may apply to cover pre-production costs already incurred.
9. Returns, Reprints & Refunds
All sales are subject to our Return & Refund Policy, which is incorporated into these Terms & Conditions by reference. Key points:
- Claims for damaged, defective, or incorrect items must be reported within 2 business days of delivery with photographic evidence
- Returns must be requested within 5 business days of delivery
- Refunds are strictly limited due to the custom nature of our products
- No refund or reprint will be issued for errors resulting from customer-approved artwork or specifications
10. Limitation of Liability
To the maximum extent permitted by applicable law, Capital Packaging LLC’s total liability for any claim arising from the use of our products or services shall not exceed the amount paid by the customer for the specific order in question.
Capital Packaging LLC shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of business, or reputational harm.
11. Warranty Disclaimer
All products are manufactured to the specifications approved by the customer. Beyond this, Capital Packaging LLC makes no additional warranties, express or implied, regarding fitness for a particular purpose or merchantability.
12. Privacy
Your use of our website is also governed by our Privacy Policy, which is incorporated into these Terms & Conditions by reference. We are committed to protecting your personal information and will not sell or share it with third parties except as required to fulfill your order or comply with the law.
13. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Texas, United States. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Texas.
14. Severability
If any provision of these Terms & Conditions is found to be unlawful, void, or unenforceable, the remaining provisions shall continue in full force and effect.
